The Proposed Overtime Violation Lawsuit

Between the dates of November 2022 and March 2023, many members of the Metropolitan Police Department (“MPD”) worked over forty (40) hours within a workweek and did not receive overtime pay as required by the Fair Labor Standards Act (FLSA).  The failure to pay overtime was brought to the attention of MPD management by the DC Police Union through the filing of a class grievance.  For months, MPD management denied that it failed to pay the proper amount of overtime due to Union members.  Finally, in August 2023, MPD management conceded that the Union was correct and made a payment of overtime wages that were worked between November of 2022 and March of 2023.  The MPD has refused to pay the penalty pay owed for these late overtime payments.  The MPD's attorney has challenged the Union’s ability to have the FLSA claim resolved through the arbitration process and insisted that members must pursue the claim through a lawsuit.

Conti Fenn LLC, the law firm that serves as General Counsel for the DC Police Union, will be filing a lawsuit against the District of Columbia seeking an award of penalty pay for the improper delay and late payment of overtime that officers were owed. The lawsuit will seek penalty pay of an equal amount of the late overtime that you were paid in August 2023 as damages for each DC Police Union member who joins this case.
